ANOVA EDU – TERMS & CONDITIONS

1. About Anova Edu

2. Application of these terms

These Terms apply to the use of Anova Edu’s website, free diagnostic tools, digital products, paid toolkits and related online services. Consultancy, project-management, policy-development, training or other professional assignments may be governed by a separate proposal, statement of work or contract. If there is a conflict, the separately signed agreement takes priority for that assignment. A product- or plan-specific policy may also apply. The Pre-Pilot Policy Toolkit Plan Terms govern assessment credits, organisation accounts, team access and permitted toolkit use.

 

3. Accounts and authorised use

Users must provide accurate information and keep account details current. Accounts and login credentials are personal and may not be shared.

An organisation’s account administrator is responsible for inviting authorised users, assigning appropriate permissions and removing access when it is no longer required. Users must not attempt to access another organisation’s information, bypass security controls or use the services unlawfully.

Anova Edu may restrict or suspend access where misuse, unauthorised access, credential sharing, fraud or a security risk is reasonably suspected.

 

4. Products and services

Descriptions, prices and included features are displayed before purchase. A purchase is completed when payment is accepted and confirmation is issued. Paid toolkit access, assessment credits and add-ons are governed by the applicable plan description and Plan Terms. Unused credits have no cash value and may not be transferred or resold. Anova Edu may improve or maintain its tools, provided that purchased rights are not materially reduced without a lawful reason or suitable remedy.

 

5. Prices, VAT and payment

Prices are shown in euros. The checkout will state whether applicable VAT or other taxes are included or added. Customers are responsible for providing accurate billing and tax information.

Payments are processed through Wix and its connected payment providers. Anova Edu does not receive or store complete payment-card details. Invoices and transaction records are retained as required by Dutch tax and accounting law.

6. Consumer withdrawal and refunds

Nothing in these Terms limits mandatory consumer rights.

Where a purchaser qualifies as a consumer under applicable law, online purchases may carry a statutory withdrawal period. For digital content or services supplied immediately, withdrawal rights may be affected only where the consumer has given the legally required express request or consent and acknowledged the consequences. Organisational or professional purchases are not refundable merely because the purchaser changes their mind or does not use the product or credits. Refunds or remedies remain available where required by law or where Anova Edu fails to provide the purchased service and does not remedy the failure within a reasonable period. Withdrawal, cancellation or refund requests may be sent to info@anovaedu.org or submitted through any cancellation function made available on the website.

7. Diagnostic and professional-use limitation

Anova Edu’s diagnostics and toolkits support structured assessment, reflection and decision-making. Results depend on the completeness and accuracy of information supplied by users.

Outputs, scores, red flags and recommendations:

  • do not constitute legal, regulatory, financial or other regulated professional advice;

  • do not certify compliance or guarantee approval, funding, implementation success or a particular outcome;

  • do not replace review by qualified legal, regulatory, technical or subject-matter professionals.

Users and their organisations remain responsible for verifying requirements and making final decisions.

8. Intellectual property

Anova Edu owns or licenses the website, Policy Development Framework, methodologies, questions, scoring logic, guidance, designs, software and supporting materials.

Users receive only the limited right to use purchased or freely provided materials for their intended internal purpose. Reports generated from an organisation’s information may be downloaded and shared internally by that organisation.

Unless Anova Edu gives written permission, users may not copy, reproduce, modify, sell, sublicense, publish, distribute, scrape, reverse-engineer or use Anova Edu materials to create a competing product. Anova Edu branding and ownership notices must not be removed.

9. User information and uploaded content

Users retain responsibility for information they enter or upload and confirm that they are authorised to process it. Users must not upload unlawful material, malware, third-party intellectual property without permission, classified or national-security information, passwords, full payment-card details or restricted personal data contrary to the applicable instructions. The handling of personal data is explained in the Anova Edu Privacy Policy. Where an organisational customer uses the toolkit to process personal data, additional data-processing terms may be required.

10. Availability and third-party services

Anova Edu takes reasonable steps to maintain secure and reliable services but cannot guarantee uninterrupted availability. Maintenance, updates, internet failures or events beyond reasonable control may temporarily affect access.

The website may rely on or link to third-party services. Those providers may apply their own terms and privacy notices. Anova Edu is not responsible for unrelated third-party websites or services it does not control.

11. Liability

Anova Edu does not exclude liability that cannot lawfully be excluded. For business customers, Anova Edu is not liable for indirect or consequential loss, loss of profit, opportunity or anticipated savings arising from reliance on diagnostic outputs. Subject to mandatory law, Anova Edu’s total liability for direct loss relating to a paid digital product is limited to the amount paid for that product. These limitations do not apply to fraud, wilful misconduct, liability for death or personal injury caused by negligence, or any other liability that cannot legally be limited.

12. Complaints

Questions or complaints should first be sent to info@anovaedu.org. Please identify the relevant purchase, service or account without sending passwords or payment-card information.

Anova Edu will seek to respond and resolve valid complaints within a reasonable period. Consumers retain access to any mandatory dispute-resolution or court rights available under applicable law.

13. Changes

Anova Edu may update these Terms to reflect legal, security or service changes. The current version and effective date will be published on www.anovaedu.org. Material changes affecting an existing paid service will be communicated where reasonably necessary.

14. Governing law

These Terms are governed by the laws of the Netherlands. This choice does not remove mandatory protections available to consumers under the law of their country of residence. Disputes that cannot be resolved informally may be submitted to a competent Dutch court, without limiting a consumer’s right to use another court where mandatory law permits.
